line-height: 150%; font-family: Arial;">Existen muchos niños y adolescentes que se encuentra inscritos en el Seguro Integral de Salud, sus enfermedades es muy costosa, los gastos del tratamiento médico continuado<span style=""> </span>oscilan entre S/. 60,000 <span style=""> </span>a 100,000.00 Nuevos soles, y el Seguro Integral de Salud solo reconoce <b style="">5 UIT</b> que representa<span style=""> </span>S/. 17,750.00 y<span style=""> </span><st1:personname productid="LA DIFERENCIA LA" st="on"><b style="">LA DIFERENCIA LA</b></st1:personname><b style=""> DEBEN PAGAR LOS PACIENTES, muchos de estos niños y adolescentes necesitan ser intervenidos</b> quirúrgicamente con carácter de urgencia a fin de <span style=""> </span>salvarles la vida, pero se encuentra en condición de espera a que el <b style="">FONDO INTANGIBLE SOLIDARIO DE SALUD</b> <b style="">LO AUTORIZE, </b>lamentablemente muchos de ellos pierden la vida durante esta espera.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11pt; line-height: 150%; font-family: Arial;"><o:p> </o:p></span></p> <p class="MsoNormal" style="margin-right: -1.6pt; text-align: justify; line-height: 150%;"><span style="font-size: 11pt; line-height: 150%; font-family: Arial;">En lo personal tuve la experiencia de toparme con un caso de estos,<span style=""> </span>en la cual me sentí en la obligación moral y humana, de velar por su derecho fundamental a la integridad personal, a la vida y a la salud, derechos reconocidos por nuestra <b style="">CONSTITUCIÓN Y</b> <st1:personname productid="LA DECLARACIￓN DE" st="on"><b style="">LA DECLARACIÓN DE</b></st1:personname><b style=""> LOS DERECHOS DE LOS NIÑOS Y ADOLESCENTES (Aprobada por <st1:personname productid="la Asamblea General" st="on">la Asamblea General</st1:personname> de <st1:personname productid="la ONU" st="on">la ONU</st1:personname> el 20 de noviembre de 1959). </b>Asimismo<b style=""> </b>EL INTERES SUPERIOR DEL NIÑO Y ADOLESCENTES, CONTEMPLADOS EN<span style=""> </span>EL ART. 1 DEL TITULO PRELIMINAR DE <st1:personname productid="LA LEY Nro." st="on">LA LEY Nro.</st1:personname> 27337 CODIGO DE NIÑO Y ADOLESCENTES.<o:p></o:p></span></p> <p class="MsoNormal" style="margin-right: -1.6pt; text-align: justify; line-height: 150%;"><span style="font-size: 11pt; line-height: 150%; font-family: Arial;"><o:p> </o:p></span></p> <p class="MsoNormal" style="margin-right: -1.6pt; text-align: justify; line-height: 150%;"><span style="font-size: 11pt; line-height: 150%; font-family: Arial;">Es así que empecé a pedirle toda su documentación respecto a su tratamiento m</span><span style="font-size: 11pt; line-height: 150%; font-family: Arial;">édico que fue suspendido por el Hospital “Dos de Mayo” debido a que la familia no contaba con recursos económicos para asumir el costo del tratamiento.<o:p></o:p></span></p> <p class="MsoNormal" style="margin-right: -1.6pt; text-align: justify; line-height: 150%;"><span style="font-size: 11pt; line-height: 150%; font-family: Arial;"><o:p> </o:p></span></p> <p class="MsoNormal" style="margin-right: -1.6pt; text-align: justify; line-height: 150%;"><span style="font-size: 11pt; line-height: 150%; font-family: Arial;">Luego de ello presenté ante el Poder Judicial una demanda de acción constitucional HABEAS CORPUS contra el Director Ejecutivo del Hospital “Dos de Mayo”, el 19 de diciembre del 2008, que en primera Instancia fue declarada improcedente la demandada,<span style=""> </span>fue apelada la sentencia y<span style=""> </span><st1:personname productid="la Instancia Superior" st="on"><st1:personname productid="la Instancia" st="on">la Instancia</st1:personname> Superior</st1:personname><span style=""> </span>Revoco la sentencia y reformándola la declaro fundada, el proceso duro alrededor de 4 meses, y actualmente esta jovencita esta siendo atendida gratuitamente por el Hospital “Dos de Mayo” asumiendo todos los gastos el Fondo Intangible Solidario de Salud (SIS), es para mi una grata satisfacción<span style=""> </span>el poder haber ayudado gracias al conocimiento de la ley y los procesos de garantías constitucionales.<o:p></o:p></span></p> <div class="blogger-post-footer"><img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/7131965860277812331-5061883114785516135?l=derechoalavidaysalud.blogspot.com' alt='' /></div>Victor Reyes Medinahttp://www.blogger.com/profile/14697970631160598524noreply@blogger.com0
